These Terms and Conditions (“Terms”) govern the use of services provided by Silverback Towing & Recovery (“we,” “us,” or “our”). By using our services, including towing, recovery, and roadside assistance, you (“Customer” or “you”) agree to comply with and be bound by these Terms. If you do not agree with these Terms, you should not use our services.
1. Services Provided
Silverback Towing & Recovery offers towing, roadside assistance, vehicle recovery, and transportation services. These services include, but are not limited to:
- Towing (light, medium, and heavy-duty)
- Winching and recovery
- Lockout assistance
- Jump starts
- Fuel delivery
- Long-distance hauling
2. Service Availability
Our services are available primarily in Virginia, North Carolina, and the East Coast of the United States. Service availability may vary depending on location, time of request, and specific service needs.
3. Customer Responsibilities
The customer is responsible for ensuring the vehicle is accessible for towing or recovery. Customers should make sure that the vehicle is not obstructing traffic and that it is in a safe location for the tow. Additionally, the customer is responsible for ensuring that all personal items are removed from the vehicle before towing or recovery.
In cases where additional equipment or effort is required (such as when a vehicle is not accessible, or unsafe conditions exist), additional fees may apply.
4. Payment Terms
Payment for services is due upon completion of the service. We accept various payment methods, including credit card, debit card, and cash. A detailed invoice will be provided to the customer, which will include the total amount for the services rendered, as well as any additional charges for special services or circumstances.
5. Cancellation Policy
Customers can cancel services prior to dispatch without incurring a fee. However, once a service has been initiated (i.e., a technician is en route or work has begun), cancellation will result in a service fee. Cancellations must be made by contacting Silverback Towing directly.
6. Liability Limitations
Silverback Towing & Recovery is not liable for any damages or losses that occur during the towing or recovery process, except in cases of gross negligence or willful misconduct. Customers should inspect their vehicle before and after services are performed and ensure that all valuables are removed from the vehicle. We are not responsible for personal items left in the vehicle.
7. Indemnification
You agree to indemnify, defend, and hold Silverback Towing & Recovery harmless from and against any and all claims, damages, losses, or expenses (including legal fees) arising out of or in connection with your use of our services.
8. Modifications
Silverback Towing & Recovery reserves the right to modify or update these Terms at any time without prior notice. Any changes to the Terms will be posted on our website and will take effect immediately upon publication.
9. Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict of law principles.
